Terms and Conditions for Victoria's Sponges

Throughout these Terms and Conditions, "we", "our", and "us" refer to Victoria's Sponges.

2. Acceptance of Orders

By placing an order with Victoria's Sponges, you agree to these Terms and Conditions.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel an order if necessary, including where payment has not been received or where we are unable to fulfil the order.

3. Products

All cakes and cupcakes are handmade to order.

Photographs on our website and social media are examples of previous work. Due to the handmade nature of our products, colours, decorations and finishing details may vary slightly from those shown.

Cake sizes, servings and decorations are approximate.

4. Allergens and Dietary Requirements

Our products are prepared in a kitchen that handles common allergens, including:

• Milk
• Eggs
• Wheat (Gluten)
• Nuts
• Peanuts
• Soya

Customers must inform us of any allergies or dietary requirements before placing an order.

Whilst every effort is made to prevent cross-contamination, we cannot guarantee that any product is completely free from allergens.

Victoria's Sponges accepts no liability for allergic reactions where allergen information has been provided.

5. Pricing and Payment

All prices are displayed in pounds sterling (£).

Full payment is required before an order is confirmed unless otherwise agreed in writing.

Prices may change without notice, but confirmed orders will not be affected.

Delivery charges will be clearly stated before payment is made.

6. Custom Cakes

Customers are responsible for ensuring that all spelling, dates, colours and design details provided are accurate.

Once a design has been agreed and production has commenced, changes may not be possible.

We reserve the right to make minor alterations to designs where necessary while maintaining the overall appearance of the agreed design.

7. Collection

Customers must collect orders on the agreed date and time.

Upon collection, responsibility for the cake passes to the customer.

Customers are responsible for transporting cakes safely and following any storage instructions provided.

Victoria's Sponges is not responsible for damage occurring after collection.

8. Delivery

We offer local delivery for an additional charge.

Delivery dates and times are estimates and may occasionally be affected by circumstances beyond our control, including traffic, weather conditions or vehicle breakdown.

Responsibility for the order transfers to the customer once delivery has been completed to the agreed address.

Customers must ensure that someone is available to receive the order at the agreed delivery time.

9. Storage and Care

Cakes and cupcakes should be stored according to any instructions provided.

Products should be kept away from direct sunlight, heat sources and excessive moisture.

Victoria's Sponges accepts no responsibility for deterioration or damage caused by incorrect storage or handling after collection or delivery.

10. Cancellations and Refunds

Standard Orders

Orders cancelled at least 7 days before the collection or delivery date may be eligible for a refund, less any costs already incurred.

Custom and Personalised Cakes

Due to the personalised nature of custom cakes and cupcakes, cancellations made after work has commenced may not be eligible for a refund.

Faulty or Incorrect Products

If you believe a product is faulty, damaged upon delivery, or not as described, please contact us within 24 hours of collection or delivery, providing photographs where possible.

Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015.

11. Celebration Cakes and Non-Edible Decorations

Some cakes may contain non-edible decorations, support dowels, wires, cake toppers or other structural components.

Customers must remove these items before consumption.

Children should always be supervised when consuming cakes containing decorative elements.

12. Intellectual Property

All photographs, logos, branding, cake designs and website content belonging to Victoria's Sponges remain our property unless otherwise agreed.

No content may be copied, reproduced or used without our written permission.

13. Limitation of Liability

Nothing in these Terms excludes liability where exclusion is not permitted by law.

Our liability for any claim relating to an order shall be limited to the amount paid for that order.

14. Privacy

Any personal information collected through our website or during the ordering process will be handled in accordance with our Privacy Policy and applicable UK data protection laws.

15. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of England and Wales.
